1. Agreement to These Terms
These Terms and Conditions (“Terms”) govern your access to and use of healtripchina.com and related services operated by Shenzhen Zhongyijia Consulting Services Co., Ltd. under the HealTripChina brand (“HealTripChina,” “we,” “us,” or “our”).
By accessing the website, submitting an inquiry, creating an account, listing a business, or using our services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the services.
2. Platform Role
HealTripChina is an information and connection platform. We may help users:
- discover and compare medical travel programs and related services in China;
- request program details or quotations;
- identify and communicate with independent hospitals, clinics, doctors, medical travel providers, translators, accommodation providers, or travel-support providers; and
- access general information about medical travel and travel planning.
Unless expressly stated in writing, HealTripChina:
- is not a hospital, clinic, medical practice, pharmacy, insurer, or travel agency;
- does not employ or control healthcare professionals listed on the platform;
- does not diagnose conditions, prescribe treatment, or provide medical advice;
- is not a party to the clinical relationship between a patient and a provider; and
- does not guarantee treatment outcomes, provider availability, prices, waiting times, visas, or travel arrangements.
3. No Medical or Emergency Advice
Website content, provider listings, program information, videos, reviews, messages, and communications are for general informational and coordination purposes only. They are not a substitute for advice from a qualified healthcare professional who has reviewed your individual circumstances.
Do not disregard professional medical advice or delay seeking care because of information on the website.
HealTripChina is not an emergency service. If you may be experiencing a medical emergency, contact the appropriate local emergency service immediately.
4. Independent Providers
Hospitals, clinics, doctors, medical travel providers, and other businesses displayed or contacted through the platform are independent third parties. They are responsible for:
- the accuracy of their credentials, licenses, listings, prices, and claims;
- evaluating whether a service is appropriate for a patient;
- obtaining informed medical consent;
- providing treatment and professional services;
- maintaining required licenses, insurance, and regulatory compliance;
- issuing clinical advice, quotations, invoices, cancellation terms, and refund terms; and
- protecting information they receive from users.
The inclusion, ranking, description, or availability of a provider does not constitute a medical recommendation, endorsement, accreditation, or guarantee by HealTripChina unless we explicitly state otherwise in writing.
You are responsible for independently reviewing provider qualifications, licenses, facilities, treatment plans, risks, costs, and terms before making a decision.
5. Program Information and Quotations
Program descriptions, inclusions, images, availability, and prices may be supplied by independent providers. They may change without notice and may not include all tests, medicines, complications, additional treatment, travel, accommodation, taxes, or other expenses.
Any quotation is preliminary unless the provider states that it is final and binding. A provider may revise a quotation after reviewing medical information or conducting an in-person examination.
HealTripChina is not responsible for differences between estimated and final costs unless a written agreement expressly states otherwise.
6. Medical, Travel, and Visa Decisions
You are responsible for:
- obtaining independent medical advice before traveling or receiving treatment;
- disclosing accurate and complete information to the treating provider;
- reviewing treatment risks, alternatives, expected outcomes, and recovery requirements;
- obtaining passports, visas, permits, insurance, vaccinations, and other travel documents;
- checking official entry, transit, and health requirements;
- arranging appropriate travel insurance and, where available, medical complication coverage; and
- determining whether you are medically fit to travel.
Visa-free, transit, and travel information on the website is general information only. Government rules may change, and official government sources control.
7. Eligibility and Accounts
You must be at least 18 years old and legally capable of entering into an agreement to use transactional features of the platform. A parent or legal guardian must act for a minor.
If you create an account, you must provide accurate information, keep credentials confidential, and promptly notify us of suspected unauthorized access. You are responsible for activity conducted through your account unless prohibited by law.
We may refuse, suspend, or close accounts that contain false information, violate these Terms, create security risks, or misuse the platform.
8. User Responsibilities
You agree to:
- provide accurate, current, and lawful information;
- use the platform only for legitimate personal or business purposes;
- communicate respectfully with providers and other users;
- protect confidential and personal information;
- obtain permission before submitting information about another person; and
- comply with applicable laws.
You must not:
- submit false medical, identity, provider, or business information;
- impersonate another person or misrepresent affiliation;
- scrape, copy, harvest, or commercially exploit platform data without permission;
- upload malware or interfere with website security or operation;
- use automated systems to submit inquiries, create accounts, or manipulate listings;
- post unlawful, defamatory, discriminatory, misleading, or infringing content;
- use the platform to solicit unlawful medical services or products; or
- attempt to bypass security, access controls, or rate limits.
9. Provider and Business Listings
Providers and business users must ensure that all submitted information is accurate, supportable, current, and compliant with applicable advertising, healthcare, consumer-protection, and professional rules.
Providers must not:
- guarantee clinical outcomes;
- publish false credentials, certifications, patient numbers, success rates, reviews, or prices;
- conceal material exclusions or fees;
- use patient images or information without valid authorization; or
- imply that HealTripChina has medically endorsed them unless expressly authorized.
We may request evidence, edit formatting, reject, suspend, or remove listings. Any review we conduct is limited and does not transfer the provider’s legal or professional responsibility to us.
10. Reviews and User Content
If you submit reviews, images, comments, or other content, you retain ownership but grant HealTripChina a non-exclusive, worldwide, royalty-free license to host, reproduce, format, translate, and display that content for operating and promoting the platform.
You represent that you have the necessary rights and permissions and that the content is truthful and does not violate privacy, confidentiality, intellectual-property, or other rights.
We may moderate or remove content, but we are not required to monitor all user content.
11. Third-Party Services and Links
The website may link to YouTube, WhatsApp, Messenger, provider websites, payment services, government websites, and other third-party services. Their own terms and privacy policies apply. We do not control and are not responsible for third-party availability, security, content, or practices.
12. Payments, Cancellations, and Refunds
Unless we expressly state that HealTripChina is collecting a particular payment, payments are made directly to independent providers and are governed by the provider’s agreement.
Before paying, you should obtain written information concerning:
- the recipient and purpose of payment;
- what is included and excluded;
- cancellation, rescheduling, and refund rules;
- currency conversion and bank charges; and
- what happens if treatment changes or cannot proceed.
HealTripChina is not responsible for provider refunds, chargebacks, deposits, or payment disputes unless we expressly accepted the payment under separate written terms.
13. Intellectual Property
The website, brand, logo, original text, design, software, and platform materials are owned by or licensed to HealTripChina and are protected by applicable intellectual-property laws.
You may use the website for personal, non-commercial purposes. You may not reproduce, modify, distribute, sell, frame, or create derivative works from platform materials without written permission, except where permitted by law.
Third-party names, videos, images, and trademarks belong to their respective owners.
14. Availability and Changes
We may modify, suspend, restrict, or discontinue any part of the website or service. We do not guarantee uninterrupted, secure, or error-free availability. Maintenance, network conditions, third-party outages, cybersecurity events, or legal requirements may affect access.
15. Disclaimers
To the fullest extent permitted by law, the services are provided on an “as is” and “as available” basis. We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and results.
We do not warrant that:
- provider or user information is complete or error-free;
- a particular provider, treatment, price, appointment, visa, or travel arrangement will be available;
- treatment will be successful or free from complications; or
- third-party services will perform as expected.
Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.
16. Limitation of Liability
To the fullest extent permitted by law, HealTripChina and its officers, employees, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive loss, or for loss of profits, opportunity, data, reputation, travel costs, or anticipated savings arising from use of the platform or dealings with an independent provider.
HealTripChina is not liable for clinical acts or omissions, diagnosis, treatment, complications, provider misconduct, travel disruption, visa refusal, or services supplied by independent third parties.
Where liability cannot be excluded, our aggregate liability arising from the platform will be limited to the greater of the amount you paid directly to HealTripChina for the relevant platform service during the six months preceding the event or USD 100, except where applicable law prohibits that limitation.
Nothing limits liability for fraud, wilful misconduct, death or personal injury caused by negligence where such liability cannot be limited, or any other liability that applicable law does not permit us to exclude.
17. Indemnity
To the extent permitted by law, business users and providers agree to indemnify HealTripChina against third-party claims, losses, and reasonable costs arising from their listings, services, content, legal violations, or breach of these Terms.
This section does not require a consumer to indemnify us where prohibited by consumer-protection law.
18. Suspension and Termination
We may restrict or terminate access where reasonably necessary to protect users, providers, the platform, or third parties; comply with law; investigate suspected misconduct; or address a material breach of these Terms.
Provisions that by their nature should survive termination, including intellectual property, disclaimers, liability, disputes, and accrued payment obligations, will survive.
19. Governing Law and Disputes
These Terms are governed by the laws of the People’s Republic of China, without regard to conflict-of-law principles.
Before filing a claim, you and HealTripChina agree to attempt in good faith to resolve the dispute by written notice and negotiation for at least 30 days.
Unless mandatory consumer law provides otherwise, courts with competent jurisdiction in Beijing, China will have exclusive jurisdiction. Consumers retain any non-waivable rights and forums available under the law of their habitual residence.
20. Changes to These Terms
We may update these Terms. The revised version will be posted with a new “Last updated” date. If a change materially affects existing registered users, we may provide additional notice where appropriate. Continued use after the effective date constitutes acceptance to the extent permitted by law.
21. General
If any provision is unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions will continue in effect.
Our failure to enforce a provision is not a waiver. You may not transfer your rights or obligations without our consent. We may assign these Terms in connection with a restructuring, merger, acquisition, or transfer of the business.
These Terms, the Privacy Policy, and any additional written terms expressly agreed for a service form the agreement between you and HealTripChina regarding the platform.
